Commitment to Privacy

My Telecom Holdings Pty Ltd ABN 78 080 661 525 (My Telecom), as the service provider behind the HomeSaver, HomeSaver Access, Oz Study Smart and IP Suite sub brands, is committed to the protection of customer personal information. My Telecom is subject to the requirements of the Telecommunications Act 1997, the Privacy Act 1988 and the Telecommunication Industry Ombudsman Scheme. This includes our Privacy Awareness Statement which has been designed to ensure that customer personal information is protected.

As a private sector company, My Telecom is bound by the Privacy Act. Under the Act, My Telecom can choose to develop and be bound by a Privacy Code or choose to comply with the National Privacy Principles in the Privacy Act. My Telecom has chosen to be bound by the National Privacy Principles.

Personal information

My Telecom only collects personal information from you that is necessary to perform its functions or if it is necessary by law. The personal information My Telecom collects about you depends on the services you request from My Telecom and the use you make of those services. Personal information held by My Telecom may include:

• your name, address and contact details;
• your date of birth;
• drivers licence and/or passport details;
• password;
• credit card details;
• information obtained as a result of credit checks which you authorise us to carry out;
• records of communications between you and My Telecom relating to services provided by My Telecom to you;
• call charge records;
• billing statements.

Use of your personal information

My Telecom respects your privacy. The primary purpose for which we use your personal information is to provide you with telecommunications services. My Telecom may also use your personal information for related purposes which include the following:

• providing you with customer service, including investigating and resolving of complaints in relation to your services;
• provisioning or connecting your services;
• network routing;
• checks for credit-worthiness and for fraud;
• billing;
• debt collection.
• to administer contractual agreements or arrangements to provide services to you;
• conducting market and product analysis and sending you product or services information.

The collection of personal information

My Telecom collects your personal information in various ways, such as over the phone, over the Internet if you transact with us on-line, or when you complete an application form for one of the products or services that we offer or promote. My Telecom collects personal information directly from you at the time when you apply for telecommunications services. My Telecom may also collect personal information from third parties such as:

• credit reporting agencies;
• other entities who provide services to My Telecom which are related to the provision of telecommunication services provided to you;
• government agencies which administer law regulating telecommunication service providers or complaint resolution processes established under those laws;
• independent sales organisations;
• resellers of telecommunications services;
• list rental companies.

Contracting out services and disclosures

My Telecom contracts some of our services to external providers and may disclose your personal information to these organisations but only so that they can provide you with the services My Telecom has contracted out.

My Telecom may disclose your personal information to other telecommunications service and equipment providers, My Telecom’s related owners’ corporations, resellers, credit providers, credit reporting agencies, organisations to whom My Telecom outsources services and My Telecom’s business partners and associates. At your request, My Telecom may disclose information to directory providers so that information can appear in directories.

Personal information shared with related bodies corporate may include your name, address and service history.

My Telecom may disclose some of your personal information such as your name and address to organisations located outside Australia in countries which do not have the same or substantially the same privacy laws but only to the extent necessary to provide you with telecommunications services requested by you.

Security

My Telecom will take reasonable steps to ensure that all information we collect, use or disclose is accurate, complete, up-to-date and stored in a secure environment accessed only by authorised persons.

Access and correction of personal information

You have the right to access the personal information we hold about you. My Telecom will generally not charge you a fee for access to your personal information, unless requests are considered unnecessarily numerous, extensive or otherwise vexatious. Also if you wish to have a copy of the personal information, charges that cover My Telecom's administrative costs of providing the information to you might apply.

If for any reason My Telecom refuses to give you access to your personal information, we will provide you with the reasons for our decision. The circumstances in which access to personal information may be limited or denied include where giving you access:

• would have an unreasonable impact on other people’s privacy;
• would prejudice any negotiations or legal proceedings between you and My Telecom;
• would prejudice the detection and investigation of unlawful activity;
• would prejudice activities carried out by, or for, a law enforcement body.

If you believe that we hold personal information that you consider to be inaccurate, incomplete or not up-to-date, please contact My Telecom. In most cases we will amend any inaccurate, incomplete or not up-to-date information. In the event of an unresolved disagreement, either you or My Telecom may append an explanatory note to the data in question.

Changes to this Statement

From time to time, it may become necessary for us to review our Privacy Awareness Statement. We reserve the right to amend our Privacy Awareness Statement at any time and to notify you by posting an updated version on the My Telecom website www.mytelecom.com.au or on our sub brand websites.
